These Terms of Service ("Terms") govern your access to cakecravers.site and describe the general terms under which Cake Cravers, Inc. accepts and fulfills cake orders. By using this website or placing an order you agree to these Terms.

1. About Us

Cake Cravers, Inc. is a custom cake bakery located at 5040 SW 21 St, West Park, FL 33023, serving Broward County and north Miami-Dade County.

2. Website Use

• Use this site for lawful purposes only.
• Do not attempt to disrupt, damage or gain unauthorized access to the site.
• Do not copy, scrape or republish our cake photographs, designs or written content without written permission.
• Do not submit false information or use our forms for unsolicited commercial messages.

3. Information Is Not An Offer

Prices, ranges, serving counts, flavor availability and lead times shown on this website, including on the homepage and pricing page, are general information for planning. They are not quotes, offers or guarantees of availability.

4. Orders And Confirmation

• Submitting the form on this website is a request, not a confirmed order.
• No date is held until we have confirmed availability with you and received the deposit.
• Your written order confirmation, listing size, servings, flavor, filling, finish, design notes, price and pickup time, controls over anything said verbally or shown on this website.
• Please read the confirmation carefully. What is written on it is what we will bake.

5. Deposits, Payment And Cancellation

Deposit, balance, change and cancellation terms are set out on our Order and Cancellation Policy page and form part of these Terms.

6. Design Interpretation

Custom cakes are made by hand. Each is a one of a kind item, and no two will be identical. Where we work from a reference photo, we produce our own interpretation in our style rather than an exact reproduction, and we will tell you before you order if a requested design is outside what we can execute well.

7. Color Matching

We match colors as closely as the medium allows. Buttercream has a natural cream base that shifts deep and cool colors warmer, and colors continue to deepen after mixing. Screens are not color accurate. Reasonable variation between a swatch and a finished cake is a characteristic of the work, not a defect.

8. Third Party Artwork And Licensed Characters

If you supply a logo, photograph or artwork for an edible print, you confirm you have the right to use it and you agree to indemnify us against claims arising from that use. We do not reproduce copyrighted characters, trademarks or another artist's work where doing so would infringe rights.

9. Allergens

Our kitchen is not free of any major allergen. Allergen terms are set out in full on our Allergen and Food Safety page and form part of these Terms. Placing an order means you have read and accepted that page.

10. Pickup

• Pickup times are scheduled and must be kept, because refrigeration space and staffing are planned around them.
• Please inspect your cake before leaving our premises. Once the cake leaves in your possession it is in your care.
• We provide handling and transport instructions. We are not responsible for damage that occurs after a cake leaves our hands.
• Cakes not collected within 24 hours of the scheduled pickup, without contact from you, may be disposed of for food safety reasons with no refund.

11. Delivery

• Delivery is quoted by distance and must be booked as part of the order.
• Someone must be present at the delivery address to receive and sign for the cake.
• We place the cake on the table or surface you designate. That surface must be level, stable, indoors or shaded, and out of direct sun and heat.
• Once the cake is set up and accepted, responsibility passes to you or your venue.
• We are not liable for delays caused by traffic, weather, venue access problems or an incorrect address.

12. Cake Care And Shelf Life

Cakes are perishable. Care and serving guidance is provided at pickup or delivery and is also summarized on our Custom Orders page. We are not responsible for the condition of a cake that has been stored, transported or displayed contrary to that guidance, including cakes left in a vehicle, in direct sun, or outdoors in Florida heat and humidity.

13. Non Edible Elements

Cakes may contain dowels, boards, supports, wires, picks, flower stems or toppers that are not edible and must be removed before serving. You are responsible for removing them and for informing whoever cuts and serves the cake.

14. Limitation Of Liability

To the maximum extent permitted by Florida law, our total liability for any claim is limited to the amount paid for the order giving rise to the claim. We are not liable for indirect, incidental, special or consequential damages, including event costs, venue fees or lost enjoyment.

15. Force Majeure

Neither party is liable for failure to perform due to events beyond reasonable control, including hurricanes, severe weather, flooding, power loss, equipment failure, ingredient shortages, illness, labor disruption or government action. Where we cannot fulfill an order for such a reason, we will notify you as early as possible and refund amounts paid for the unfulfilled portion.

16. Governing Law

These Terms are governed by the laws of the State of Florida. Disputes shall be brought in the state or federal courts located in Broward County, Florida.

17. Changes And Contact

We may revise these Terms at any time. Changes take effect when posted with an updated date. Where a written order confirmation conflicts with these Terms, the confirmation controls for that order.
